Terms and Conditions:
The following constitute the terms and conditions between Mountain West Model Trains and our customers and vendors. Hereafter, Mountain West Model Trains is referred to as MWMT. The word customer and vendor are used to denote those with whom we do business.
- Privacy: MWMT does not engage in the practice of selling, distributing or otherwise sharing the information of customers and vendors with vendors or other third party suppliers. It is our mission and goal to protect the identity and information of all customers and vendors to the extent possible. MWMT is not responsible for breaches to this policy outside of our control. In the event that MWMT is compromised in anyway and in the event that we learn of such compromise, we will inform all customers and vendors at once.
- Return Policy: Items that are damaged or broken in transit may be returned. MWMT reserves the right to repair or replace such items and return them to the customer. Items damaged or broken as a result of normal use, shall be directed to the manufacturer for any and all warranties that may exist as a result of normal ownership. MWMT is not responsible for warranties provided by the vendors and companies that we supply. Items that a customer may not "like" can be returned for a 20% restocking fee, minus any shipping charges that may have been the responsibility of MWMT. Direct in kind exchanges may be made so long as the customer pays all shipping and handling charges. New items can not be returned or exchanged for used items.
- Used Items: MWMT is not responsible for the condition of used items sold by MWMT. Used items are considered "as is where is" and the customer assumes all responsibility in terms of quality and operation of used items. Used items shall be tested by MWMT and all defects, if any, shall be reported to the customer prior to shipment. Used items can not be returned or exchanged in kind. All used item sales are final.
- Shipping Policy: All shipping is calculated by our website provider, we do our best to offer affordable shipping rates. All orders over $400 will not have any shipping charge.
- Refund Policy: Refunds are granted on a case by case basis only. Refunds shall not be offered unless items have been returned and inspected by MWMT. MWMT reserves the right to inspect the items prior to refund and, reserves no less than 30 days to inspect and grant a refund if warranted. If we do not have an item we will issue a full refund for the item.
- Right of Service: MWMT reserves the right to deny service to any customer for any lawful reason at any time at the discretion of MWMT management.
- Copyright: The use of MWMT promotions, pictures or property (intellectual or otherwise) is strictly prohibited without the written consent of MWMT management. All MWMT branding is strictly protected by United States Copyright Laws and regulations.
- Pre-orders/Back orders: MWMT is not responsible for the cancellation, change or delay of pre-orders from our vendors. All pre-orders are subject to cancellation. Pre-order payments shall be returned to the best of our ability with-in 5 working days of notice of project cancellation. Payment for pre-orders is NOT required in advance. Payment will be REQUIRED when the item(s) arrives at our distributor. MWMT will not accept backorders on speculation. Back orders will only be accepted when vendors have verified production runs of back ordered items. MWMT has a no cancelling preorder policy for customers, we can make acceptations on a case by case basis.
- Payment methods: MWMT currently accepts the following methods of payment. All payments to made in US Dollars. WMT does not exchange currencies on open trade exchange rates. Acceptable payments include and are limited to; Apple Pay, Visa, AmEx, Mastercard, Diners Club, Google Pay, PayPal, JCB, Shopify Pay, VenMo. MWMT does not accept any form of Crypo Currency or Ether Currency, BitCoin at this time.
- Errors and Omissions: In the event that MWMT misquotes a price or a delivery date or a specification of an item, MWMT reserves the right to present such problems to the customer with the correct information. The customer reserves the right to to honor or disband the order upon review of the required changes.
- If you are not happy with the service or product you have received from us please get in touch with us, we will do everything we can to make it right! If your product arrived with a defect or issue please let us know and we will get you in touch with the manufacturer so they can assist you further in getting it fixed. We are always looking for ways to improve our QC and shipping processes and want to see or know if we can improve it!
